ACLU sues DOC to distribute legal publication | Florida Politics | Sun ...

TALLAHASSEE -- The American Civil Liberties Union and the Florida Justice Institute sued the Florida Department of Corrections today, alleging that the state was barring inmates from receiving publications about their legal rights.

According to the ACLU, the state violated the first amendment's right to free speech and the 14th amendment of due process by barring the distribution of Prison Legal News, a monthly publication containing writings from legal scholars, attorneys, prisoners and news wire services about legal issues in prisons. The case is filed on behalf of Prison Legal News in the U.S. District Court in Miami.

?When the government blocks information based on the content of that information, that?s censorship,? said Randall Marshall, Legal Director for the ACLU of Florida, in a press release. ?These publications provide inmates with vital information about their legal rights and individuals in FDOC custody have a right to access these publications.?
