Clean air, water rules spark different responses (AP)

WASHINGTON ? Large and small companies have told Republican-led congressional committees what the party wants to hear: dire predictions of plant closings and layoffs if the Obama administration succeeds with plans to further curb air and water pollution.

But their message to financial regulators and investors conveys less gloom and certainty.

The administration itself has clouded the picture by withdrawing or postponing some of the environmental initiatives that industry labeled as being among the most onerous.

Still, Republicans plan to make what they say is regulatory overreach a 2012 campaign issue, taking aim at President Barack Obama, congressional Democrats and an aggressive Environmental Protection Agency.

"Republicans will be talking to voters this campaign season about how to keep Washington out of the way, so that job creators can feel confident again to create jobs for Americans," said Joanna Burgos, a spokeswoman for the House Republican campaign organization.

The Associated Press compared the companies' congressional testimony to company reports submitted to the Securities and Exchange Commission. The reports to the SEC consistently said the impact of environmental proposals is unknown or would not cause serious financial harm to a firm's finances.

Companies can legitimately argue that their less gloomy SEC filings are correct, since most of the tougher anti-pollution proposals have not been finalized. And their officials' testimony before congressional committees was sometimes on behalf of ? and written by ? trade associations, a perspective that can differ from an individual company's view.

But the disparity in the messages shows that in a political environment, business has no misgivings about describing potential economic horror stories to lawmakers.

"As an industry, we have said this before, we face a potential regulatory train wreck," Anthony Earley Jr., then the executive chairman of DTE Energy in Michigan, told a House committee on April 15. "Without the right policy, we could be headed for disaster."

The severe economic consequences, he said, would be devastating to the electric utility's customers, especially Detroit residents who "simply cannot afford" higher rates.

Earley, who is now chairman and CEO of Pacific Gas & Electric Corp., said if the EPA had its way, coal-fired plants would be replaced with natural gas ? leading to a spike in gas prices. He said he was testifying for the electric industry, not just his company.

But in its quarterly report to the SEC, Detroit-based DTE, which serves 3 million utility customers in Michigan, said that it was "reviewing potential impacts of the proposed and recently finalized rules, but is not able to quantify the financial impact ... at this time."

Skiles Boyd, a DTE vice president for environmental issues, said in an interview that the testimony was meant to convey the potential economic hardship on ratepayers ? while the SEC report focused on the company's financial condition.

"It's two different subjects," he said.

Another congressional witness, Jim Pearce of chemical company FMC Corp., told a House hearing last Feb. 9: "The current U.S. approach to regulating greenhouse gases ... will lead U.S. natural soda ash producers to lose significant business to our offshore rivals...." Soda ash is used to produce glass, and is a major component of the company's business..

But in its annual report covering 2010 and submitted to the SEC 13 days after the testimony, the company said it was "premature to make any estimate of the costs of complying with un-enacted federal climate change legislation, or as yet un-implemented federal regulations in the United States." The Philadelphia-based company did not respond to a request for comment..

California Rep. Henry Waxman, the senior Democrat on the House Energy and Commerce Committee, said the SEC filings "show that the anti-regulation rhetoric in Washington is political hot air with little or no connection to reality."

House Republicans have conducted dozens of hearings, and passed more than a dozen bills to stop proposed environmental rules. So far, all the GOP bills have gone nowhere in the Democratic-run Senate.

"I will see to it, to the best of my ability, to try to stop everything," California Sen . Barbara Boxer, the Democratic chairman of the Senate's environment committee, vowed in reference to GOP legislation aimed at reining in the EPA. She predicted Republicans "will lose seats over this."

The Obama administration has reconsidered some of the environmental proposals in response to the drumbeat from business groups. In September, the president scrubbed a clean-air regulation that aimed to reduce health-threatening smog. Last May, EPA delayed indefinitely regulations to reduce toxic pollution from boilers and incinerators.

James Rubright, CEO of Rock-Tenn Co., a Norcross, Ga.-based producer of corrugated-and-consumer packaging, told a House panel in September that a variety of EPA, job safety and chemical security regulations would require "significant capital investment" ? money that "otherwise go to growth in manufacturing capacity and the attendant production of jobs."

Rubright conveyed a consulting firm's conclusion that EPA's original boiler proposal before the Obama administration withdrew it in May would have cost the forest products industry about $7 billion, and the packaging industry $6.8 billion.

Another industry study, he said, warned that original boiler rule would have placed 36 mills at risk and would have jeopardized more than 20,000 jobs in the pulp and paper industries ? about 18 percent of the work force.

But a month before his testimony_ and three months after EPA withdrew its boiler proposal ? Rock-Tenn told the SEC that "future compliance with these environmental laws and regulations will not have a material adverse effect on our results or operations, financial condition or cash flows." The company did not respond to a request for comment.

Mars or Bust: NASA Launches Mars Science Laboratory

UPDATE, Nov. 26: NASA successfully launched the Mars Science Laboratory this morning, beginning the new rover's long journey to the Red Planet.

After a planned launch on Nov. 26, 2011, the Mars Science Laboratory (MSL), aka Curiosity, will reach Mars in August, the third Red Planet landing since the rovers Spirit and Opportunity touched down in 2004. Those machines were impressive, but they stand in the large shadow of Curiosity, which?at 10 feet long and 1984 pounds?is twice as long and five times as heavy as its predecessors. "The thing about MSL is how much bigger it is," Diana Blaney, a mission co-investigator, says. "The instruments are much more complex, plus we're on a mobile platform."

Curiosity picks up where the 2008 Mars Phoenix Lander left off; that mission proved the existence of water on Mars and discovered perchlorate, a potential food source for microbes. Curiosity hopes to show there's organic material on Mars, a requirement for habitability. "If you have sources of food and water and organic material, you could say, you have the building blocks of life," Curiosity co-investigator Nilton Renno says.

The Power Source

Engineers hope Curiosity will rove for at least two years, relying on a unique power source. NASA is forgoing solar panels of the past, and instead packing the rover with nuclear-powered batteries called Radioisotope Thermoelectric Generators (RTGs). Drawing energy from the natural decay of plutonium-238, RTGs produce almost five times more power than solar panels on previous rovers. They also perform well in conditions that are dusty or without sunlight.

The SAM

Among its other functions, the Sample Analysis at Mars (SAM) suite features a remote-sensing device capable of targeting pinhead areas on rock formations from up to seven meters away. ChemCam, as it is known, can then shoot a laser beam at the rock and analyze the vaporized material using a light-reading spectrograph. "It has the potential to really study chemical evolution at a different scale than before," co-investigator Blaney says. "We'll be able to map composition at a fine scale." The SAM suite consists of three instruments. The aforementioned tunable laser beam, a Quadrupole Mass Spectrometer (QMS), and a Gas Chromatograph (GC). This scientific trinity will work to analyze samples on the surface, inside Martian boulders and below ground, searching for the organic building blocks of life.

Wheels and Actuators

At 20-inches in diameter, Curiosity's wheels are larger than those of an average car?and twice the size of those on the Spirit and Opportunity rovers. To maneuvering over rough Martian landscape, each wheel features high-traction cleats and a dedicated motor. The front and rear wheels actually have two motors apiece, enabling independent steering. All of this makes for impressive handling: Curiosity can turn 360 degrees in place. But its impressive mobility came at a price. A snafu in the development and testing of the actuator motors caused a two-year launch delay, and added $560 million to the cost of building and deploying the rover.

The Landing System

Unlike its smaller roving cousins, which used airbags to cushion their entry on Mars, MSL is far too large and heavy (nearly a ton) to bounce to safety on Mars. Engineers devised a unique, only-in-the-dreams-of-a-NASA-engineer, precision system based on a rocket-powered backpack called Sky Crane. In the initial stages of descent, a parachute 165 feet in diameter deploys. The parachute jettisons, and rockets kick in, providing upward thrust to further slow the rover's descent. Radar detects the landing surface and orients the crane upright. Hovering with the aid of the rocket streams, the crane lowers the rover to the surface on cables, then releases Curiosity to begin its amazing mission.

Space 'superbubbles' could spawn cosmic rays

Enigmatic cosmic rays that strike Earth with giant amounts of energy might come from hot gaseous "superbubbles" in space, a new study reveals.

Cosmic rays have perplexed scientists for a century. These electrically charged particles bombard Earth with energies dwarfing anything we are capable of, but their origins remain a mystery.

Since cosmic rays are electrically charged, they can get pushed and pulled around by interstellar magnetic fields in the gas between the stars as they zip through space, obscuring where they come from.

One suspected fountain of cosmic rays are star-forming regions. The massive stars within these stellar nurseries can spew out massive amounts of energy and explode as supernovas.

Now scientists may have pinpointed cosmic rays coming from a superbubble, one caused by powerful winds from clusters of young, massive stars punching into the surrounding molecular clouds of gas and dust.

The superbubble in question lies in the Cygnus X region of the sky, within the constellation Cygnus, the Swan. It was likely created by clusters of massive stars, such as the Cygnus OB2 association, a very large cluster about 4,500 light-years away. The cluster contains more than 500 stars, each more than 10 times the mass of our sun.

NASA's Fermi Large Area Telescope detected a wide range of gamma rays ? the most energetic form of light ? emanating from a space about 160 light-years wide. The spectrum of gamma rays seen match those one would expect freshly generated cosmic rays to give off.

"For the first time, we have caught a glimpse of the early life of cosmic rays in these regions of massive star formation," study co-author Luigi Tibaldo, an experimental physicist at Padova University and Italy's National Institute of Nuclear Physics, told SPACE.com.

The gamma rays the researchers detected appear confined within this superbubble, which might suggest the cosmic rays creating them "seem trapped, as if they have a hard time getting out," study co-author Isabelle Grenier, an astronomer and astrophysicist at Paris Diderot University in France, told SPACE.com.

"This might really change the way we think cosmic rays propagate, and if they're giving off energy as they're trapped inside star-forming regions, they may be changing the chemistry within, affecting how stars form," Grenier said.

The scientists detailed their findings in the Nov. 25 issue of the journal Science.

2 new radio stations in Zimbabwe get licenses (AP)

HARARE, Zimbabwe ? The state broadcasting authority says it has issued two licenses to commercial radio stations to compete with the sole government-owned broadcaster loyal to Zimbabwe's president.

The independent Media Institute of Southern Africa on Friday criticized the announcement by the authority and said the new stations were not fairly chosen by officials appointed by the information ministry run by President Robert Mugabe party.

Zimbabwe Newspapers, publishers of the main pro-Mugabe daily Herald, will launch a Talk Radio channel. The second channel, ZiFM, is controlled by a black empowerment campaigner and stalwart of Mugabe's party who says it will go on air within six months.

A coalition deal with the former opposition in 2009 called for an end to the three decade monopoly of Mugabe's Zimbabwe Broadcasting Corp.

?Star Trek? 3D sequel gets 2013 release date

Paramount Pictures has pushed its "Star Trek" sequel back nearly a year, from June 2012 to May 17, 2013.

  1. More Entertainment stories
    1. Three judges are left standing on 'X Factor'

Paula Abdul became the first judge to zero out on ?X Factor? when Lakoda Rayne got the fewest number of votes on Wednesday.

    2. Bachmann: Fallon song choice was sexist
    3. J.Lo didn't drive that Fiat 'round the block
    4. 'Breaking Bad' boss doesn't know how it'll end
    5. 'Arthur Christmas' a jolly new holiday tradition

Paramount announced the new date on Wednesday, but it actually removed "Star Trek" from its June 29, 2012, slot several months ago, when it put "G.I. Joe 2: Retaliation" into the spot.

Directed, written and produced by J. J. Abrams, the sequel will be in 3D and star Chris Pine, Zachary Quinto, Anton Yelchin and Zoe Saldana as Capt. Kirk, Spock, Chekov and Uhura -- the parts they played in the 2009 hit "Star Trek."

The new movie remains untitled.

May 17 is a coveted date, just before Memorial Day. Sony recently removed Roland Emmerich's sci-fi "Singularity" from the date, making it all the more attractive for Paramount.

Alex Kurtzman, Damon Lindelof and Roberto Orci also are writing and producing. Bryan Burk is producing.

The 2009 "Star Trek" also opened in May and grossed $257.7 million domestically and $127.9 million internationally. It had a budget estimated at $150 million.

"Happy Feet Two" flop leads to 600 layoffs: report (Reuters)

LOS ANGELES (TheWrap.com) ? As a result of the poor box-office performance of "Happy Feet Two," 600 of the 700 employees at the digital production studio behind the animated movie reportedly have received their walking papers.

Employees at Dr. D Studios, which is based in Sydney, Australia, have been told they will be laid off in the coming weeks, according to IF.com.au. TheWrap was unable to reach Dr. D for comment.

The film, a sequel to 2006's Academy Award-winning "Happy Feet" -- which grossed $384.3 million off a budget of $100 million -- had amassed only an estimated $30.3 million worldwide as of Thursday.

There may be a silver lining for some of the employees, who reportedly have been offered a job at a new company that Kennedy-Miller Mitchell Films -- which launched Dr. D as a joint partnership with Omnilab Media -- plans to get off the ground in early 2012. KMM was founded in 1973 by "Happy Feet" director George Miller and producer Byron Kennedy.

In addition to the layoffs, KMM and Omnilab are reportedly at odds, and there is the possibility that the partnership between the two companies may be dissolved.

Released on November 18, "Happy Feet Two" has not found much success. It opened in 3,606 theaters and came in second at the box office during its debut weekend, grossing $21.2 million. Its estimated budget was $140 million.

"We obviously came in a little bit under our expectations on 'Happy Feet,' " Warner Bros. President of Distribution Dan Fellman told TheWrap. "The market expands enormously over the holiday. By next Monday, we'll know whether we're in good shape."

With three new family films released this week -- "The Muppets," "Hugo" and "Arthur Christmas" -- "Happy Feet Two" is unlikely to gain further traction.

Dr. D Studios, which specializes in digital feature film production and high-end special effects, reportedly had hoped to compete with Peter Jackson's Weta Digital in neighboring New Zealand. The studio is also attached to the long-delayed fourth "Mad Max" film, "Fury Road"; Miller was the director, producer and writer for the first three installments.

According to DrDStudios.com, "Fury Road" is in pre-production, although the site also includes an out-of-date notice that "Happy Feet Two" is in production. There are no job openings listed on the site.

Interactive turkey trots onto Google homepage

Google

By Rosa Golijan

The Google homepage is ready for Thanksgiving, but there's not a roasted, fried, or otherwise cooked bird involved. No, instead there's a delightfully interactive turkey who looks ready to strut around your screen.

The turkey is Google's latest doodle?? a redesigned version of the search engine's homepage logo ? and it's a throwback to the days of tracing our hands with crayons and turning the resulting patterns into Thanksgiving-themed masterpieces.

Just like those hand turkeys of Thanksgiving past, the Google doodle can be customized to suit your personality. By clicking on various parts of the bird you can change its headpiece, footwear, or individual feathers. (If you'd rather let chance decide how your turkey should look, just tug on its wings and see what happens.)

Once you've created the turkey of your dreams, you can share it via Google+ or by grabbing a shortened URL leading to your creation ??just click on the corresponding button on the doodle's right.

Congo opposition official killed days before poll (AP)

KINSHASA, Congo ? A police official in Congo's capital says a local opposition politician has been killed just days before a major vote in the central African nation.

Police inspector general Charles Bisengimana said Wednesday that provincial assembly representative Marius Gangale was killed Tuesday night in Kinshasa. Gangale's wife says she was in the car with her husband when two attackers shot him and demanded her belongings.

Gangale was a leader in a major opposition party. He was not running in the Nov. 28 election for the presidency and legislature.

Human rights groups are expressing fears about an atmosphere of spiraling violence and hate speech ahead of the vote in the vast mineral-rich nation. The outcome of the vote is almost certain to keep President Joseph Kabila in power.

NH gay marriage push highlights GOP shifts (AP)

CONCORD, N.H. ? Whether they like it or not, Republican presidential candidates are joining New Hampshire's intensifying gay marriage debate.

State lawmakers plan in the coming weeks to take up a measure to repeal the law allowing same-sex couples to wed and a vote is expected at some point in January ? the same month as New Hampshire holds the nation's first Republican presidential primary contest.

Already, candidates have been put on the spot over the divisive hot-button social issue when most, if not all, would rather be talking about the economy, voters' No. 1 concern.

The impending focus on gay marriage carries risk for several of White House contenders ? including former Massachusetts Gov. Mitt Romney, Texas Gov. Rick Perry and former businessman Herman Cain ? whose inconsistencies on the topic are well documented. The GOP candidates' increasingly vocal support for "traditional marriage" also threatens to alienate a growing number of younger Republicans and independents here who support legal recognition of same-sex couples. That note of divisiveness could bode poorly for the eventual GOP nominee come the general election.

Even so, the Republican candidates aren't shying away from the topic as they run for the nomination of a GOP dominated by conservatives and pushed further to the right by the tea party over the last few years.

"As conservatives, we believe in the sanctity of life, we believe in the sanctity of traditional marriage, and I applaud those legislators in New Hampshire who are working to defend marriage between one man and one woman realizing that children need to be raised in a loving home by a mother and a father," Perry told a New Hampshire audience recently, becoming the latest contender to address gay marriage directly.

While the issue hasn't yet become a regular talking point on the campaign trail, most Republican candidates declare support for the effort to repeal the law. And groups like the National Organization for Marriage hope to force the presidential contenders to publicly embrace the repeal.

"We will be using all the tools at our disposal to lobby the New Hampshire legislature and the broader population," said Christopher Plante, regional director for the National Organization for Marriage. "One of those tools is the echo chamber of presidential candidates continuing to show their support of marriage as defined by one man and one woman."

Plante concedes that for some candidates, "there has been an evolution on a number of fronts" on this issue.

Romney was the Massachusetts governor when his state legalized gay marriage. The Romney administration, as directed by the courts, granted nearly 200 same-sex marriage requests for gay and lesbian couples in 2005.

Campaign spokesman Ryan Williams said the former governor had little choice but to follow the state Supreme Court ruling at the time. He noted his candidate's consistent opposition to both civil unions and gay marriages, adding that Romney openly supports the New Hampshire repeal effort.

But Romney has reversed himself on whether gay marriage should be addressed at the state or federal level.

This past June, he said during a debate that he favors a federal constitutional amendment banning the practice. That's been his position at least since the beginning of his 2008 presidential bid, when he was the only major Republican candidate to support such an amendment.

But as a Massachusetts Senate candidate back in 1994, Romney told a Boston-area gay newspaper that same-sex marriage is "a state issue as you know ? the authorization of marriage on a same-sex basis falls under state jurisdiction." Aides say it's unfair to scrutinize Romney's position in 1994 ? when there was virtually no discussion of a federal amendment. And they suggest Romney's rivals have far more blatant inconsistencies in recent months.

Both Perry and Cain have drawn conservative criticism for recent comments related to gay marriage.

Asked in mid-October whether he supports a federal marriage amendment, Cain told the Christian Broadcasting Network that federal legislation is necessary to protect traditional marriage. That seemed to be a direct contradiction from his statement of just six days earlier, when he told "Meet the Press" host David Gregory that states should be allowed to make up their own minds.

"I wouldn't seek a constitutional ban for same sex marriage, but I am pro traditional marriage," Cain told Gregory.

In Perry's case, the Texas governor says he supports the New Hampshire repeal. But in July he said that New York's move to legalize gay marriage was "fine by me." A week later, facing social conservative criticism, he walked back the comments.

"It's fine with me that the state is using their sovereign right to decide an issue. Obviously gay marriage is not fine with me," he said then.

Former House Speaker Newt Gingrich has another problem.

Earlier in the fall, he told an Iowa audience that gay marriage is a "temporary aberration" likely to go away because it defies convention. Gingrich, who has been married three times, has a half-sister in a same-sex marriage.

"The truth is that you're living in a world that no longer exists," Candace Gingrich-Jones wrote the former speaker in a letter posted on the Huffington Post in 2008: "In other words, stop being a hater, big bro."

Despite the presidential candidates' support for the New Hampshire repeal, younger Republicans in this state are skeptical, especially as voters are focused on the economy.

"Why is the NH House wasting time trying to repeal gay marriage? Capital ugh," Robert J. Johnson, chairman of the New Hampshire College Republicans, wrote on Twitter.

Polling suggests it may not be a winning issue.

A recent University of New Hampshire poll found that 62 percent of state residents oppose repealing the same-sex marriage law. And nationally, public opinion has gradually shifted toward supporting same-sex marriages, even among Republicans.

An August Associated Press-National Constitution Center poll found that 53 percent of Americans favor legal recognition of same-sex marriages; 32 percent of Republicans say same-sex couples should get some legal recognition from the government, compared with 71 percent among Democrats and 50 percent of independents.

Democrats hope to use the Republican contenders' positions against them in the general election next fall.

"While these radical stances might win them a few votes in their primary, it will lose them the support of the majority Americans, and ultimately put them on the losing side of history," said Ty Matsdorf, spokesman for American Bridge, an independent group aligned with Democrats.

360 Panorama app now available for Android users, no gyroscope necessary (video)

Looking to capture panoramic photos on an Android handset? Well, you've certainly got plenty of options -- including, as of today, Occipital's 360 Panorama, which just hit the Android Market. Compatible with devices running Android 2.3 or above (with the exception of Honeycomb), the app offers much of the same functionality you'll find on the previously released iOS version. Just tap a button, pan your handset across any given area and watch your photo come to fruition before your very eyes. The tool also allows exposure to fluctuate as a user pans his or her device, thereby creating the potential for HDR panoramic shots during transitions from dark to bright areas. Interestingly enough, this version relies not upon an actual gyroscope, but a "simulated" one, created from motion-tracking algorithms (that's how it works on older 3GS handsets, as well). Users who already have a 360 Panorama account can still use it on their Android handsets, allowing them to upload and store all their photos in one place. Eventually, this storage system will allow for syncing across both iOS and Android hemispheres, though at the moment, it's a strictly web-based affair. Pan past the break for a brief demo video, or check out some sample shots in the gallery, below.

Bush tax cut debate dooms deal to cut deficit

(AP) ? A long-running war between Democrats and Republicans over Bush-era tax cuts doomed the debt supercommittee's chances of reaching a deal. Efforts to overhaul the tax code may await the same fate as both parties gear up to make taxes a central issue in 2012 elections.

Republicans insisted during the supercommittee negotiations that curbing tax breaks to raise revenues be coupled with guarantees that all the Bush tax cuts would continue beyond 2012. The tax cuts, which affect families at every income level, were enacted under President George W. Bush and were extended through 2012 under President Barack Obama.

Republicans for years have bashed Democrats as eager to raise taxes ? a theme they will employ often in next year's elections ? so they weren't about to agree to a tax hike unless they also could take credit for preventing a huge tax increase scheduled to take effect in 2013.

Democrats countered that the supercommittee was created to reduce the budget deficit, not add to it by extending tax cuts. Most Democrats, including Obama, want to extend the Bush tax cuts only to individuals making less than $200,000 a year and married couples making less than $250,000.

"We simply could not overcome the Republican insistence on making tax cuts for the wealthiest Americans permanent," said Sen. John Kerry, D-Mass., a member of the supercommittee. "This was simply doctrine for some of our Republican colleagues, even as many worked very hard in good faith to find a better way forward."

Another member of the supercommittee, Rep. Dave Camp, R-Mich., said, "It is deeply regrettable that my Democrat colleagues could not see their way to addressing these much-needed reforms without at least $1 trillion in job-killing tax increases on families and employers."

Extending all the Bush tax cuts, including provisions to spare millions of middle-class families from paying the alternative minimum tax, would add $3.9 trillion to the budget deficit over the next decade, according to projections by the nonpartisan Congressional Budget Office. The Democratic plan would add about $3.1 trillion to the deficit over the same period and make the wealthiest Americans pay about $800 billion more in taxes.

The supercommittee was formed to come up with a package that reduces government borrowing by at least $1.2 trillion over the next decade. But with a Wednesday deadline approaching, the committee's co-chairs conceded failure Monday.

"After months of hard work and intense deliberations, we have come to the conclusion today that it will not be possible to make any bipartisan agreement available to the public before the committee's deadline," said a joint statement by the co-chairs, Rep. Jeb Hensarling, R-Texas, and Sen. Patty Murray, D-Wash.

Democrats had said they would accept significant cuts to benefit programs like Medicare and Medicaid, but only if Republicans would agree to tax increases. Despite Republicans' aversion to tax increases, a growing number of GOP lawmakers said they would consider higher taxes if they were coupled with significant spending cuts.

Other Republicans wanted even more political cover: a guarantee that all the Bush tax cuts would be made permanent.

"It's not easy during this hard economic time to go back and justify any kind of tax increase," Rep. Wally Herger of California, a senior Republican on the tax-writing House Ways and Means Committee, said while talks were still ongoing. "But I think if it's going to be justified, this is the one exception that maybe you could use to justify it."

At one point, supercommittee member Sen. Pat Toomey, R-Pa., proposed a tax overhaul package that Republicans said would raise about $290 billion in additional revenue over the next decade but lock in all of the Bush tax cuts.

Democrats, however, never seriously considered an agreement to continue the Bush tax cuts for high earners. Agreeing to extend them would make it harder for Democrats to accuse Republicans of supporting policies that favor the wealthy, a staple of Democratic political campaigns.

"If anybody in our party votes for that, they will have a real problem for themselves in the next election," said Rep. Jim McDermott of Washington, a senior Democrat on the Ways and Means Committee.

The debate has played out even as lawmakers, presidential candidates and interest groups from across the political spectrum have called on Congress to simplify the tax code. The two tax-writing committees in Congress, the Ways and Means Committee in the House and the Finance Committee in the Senate, have held numerous hearings on tax reform. Their respective chairmen, Camp and Sen. Max Baucus, D-Mont., both served on the supercommittee.

But tax reform won't happen until Congress resolves the dispute over the Bush tax cuts, said Howard Gleckman, a fellow at the Urban Institute and editor of the blog TaxVox.

"You can't do tax reform unless you agree in advance how much revenue you want to raise," Gleckman said. "The problem is, there is simply no consensus at all on what the revenue goal is."

Tax reform is already a hot topic among Republican presidential hopefuls. Businessman Herman Cain has gotten a lot of attention for his 9-9-9 plan, which would impose a 9 percent national sales tax, a 9 percent income tax and a 9 percent business tax.

The election could go a long way toward deciding the fate of tax reform. Until then, don't look for any movement on the issue, said Dean Zerbe, former tax counsel to the Senate Finance Committee and now national managing director of Alliantgroup, a tax consulting firm.

"'For this Congress, you might as well send the lilies for tax reform," Zerbe said. "We will not do anything significant on taxes until after the election, and even after that it may take a while."

Sandusky charity weighing options, including closing (Reuters)

STATE COLLEGE, Pa (Reuters) ? The charity founded by Jerry Sandusky, the former Penn State football coach charged in an explosive child sex abuse scandal, is weighing options for its future, including shutting down, the non-profit group said.

The Second Mile charity, which works with at-risk youths, is talking with donors and supporters to determine what support it can expect, it said in a statement.

"Because the focus of our organization is on the children, The Second Mile is currently exploring three options: (1) restructuring the organization and keeping its programs going, even if it means doing so at a reduced level of service and funding, (2) maintaining the programs by transferring them to other organizations or (3) not continuing," the statement said.

"Our primary goal is to sustain the programs for the sake of the kids."

Sandusky, 67, faces 40 grand jury charges of sexually abusing eight young boys over 15 years. He retired as Penn State defensive coordinator in 1999 and is alleged to have met the boys through The Second Mile, which he started in 1977.

A source close to the situation said on Sunday that The Second Mile was focused on carrying out its own investigation into the charges.

The charity, which has about 30 staff members, also is talking with potential partners about taking over some of the programs, the source said. The source declined to disclose those involved in the talks.

SOMETHING TO SALVAGE

New Chief Executive David Woodle "is trying to make sure that something can be salvaged from this charity, because there are a lot of good programs that people depend on," the source said.

Woodle took over from Jack Raykovitz, who resigned on November 13. About a quarter of the 32-member board has quit since the charges against Sandusky were announced on November 5, the source said.

The grand jury charges, including allegations that Sandusky raped a young boy in a football facility shower in 2002, have shredded Penn State's reputation and administration.

Joe Paterno, the winningest coach ever in major college football, and President Graham Spanier were fired by trustees on November 9 in the wake of allegations against Sandusky.

The athletic director and a senior university finance official stepped down after being charged with failure to report an incident and perjury for giving false testimony to the grand jury.

Sandusky said in an interview last week on NBC television that he was innocent. The Second Mile has said Sandusky was separated from activities involving children in 2008, when he told the group about the grand jury investigation.

Penn State faces a battery of investigations, including one by the U.S. Department of Education. The National Collegiate Athletic Association and the board of trustees also have announced probes.

Counting China's wild pandas

By Adrienne Mong

YINGJING, SICHUAN?The panda was always one of my favorite animals.

Until I found myself slipping and sliding down a steep muddy mountain slope in southwestern Sichuan, looking for panda poop.

To be precise, someone else was searching.?

My colleagues and I were just attempting to keep up with him on what was easily one of the more physically grueling NBC News assignments we?d all been on in years.

Li Guiren, a fleet-footed 36-year old Sichuan native who works at the Chinese Forestry Department, was hiking through the mud, following coordinates on his bright yellow GPS device.? He?s one of 70 ?trackers? working in Sichuan to count pandas in the wild?which they do by collecting panda droppings.? (More on that in a moment.)

China kicked off its panda census last month.? It?s the fourth one since the 1970s, when they instituted the practice to keep tabs on the worldwide panda bear count every?10 years.

The wild panda is only found in China, across parts of three provinces of Sichuan, Gansu, and Shaanxi, covering 5,400 square miles.? Or the size of Connecticut.

The bears like being high up, usually somewhere between 4,000 and 11,500 square feet above sea level in mountain forests with a damp climate.

The last census revealed only 1,596 wild pandas existed with 290 pandas in captivity around the world.

Adrienne Mong / NBC News

Li Guiren takes notes on the geography on a Sichuan mountain.

?About 70 to 80?percent [of all the pandas in the world] live in Sichuan,? said Huang Zhi of the Bifengxia Panda Breeding Center in Ya?an, Sichuan.? ?Sichuan also has the highest number of wild pandas.?

Trackers in the field
Sichuan is also where the two-year panda census project has launched.? Smaller teams in Gansu and Shaanxi will begin working in the field next year.

Early in the morning, a group of twenty men suited up in wet-weather clothes and thin boots.? They reviewed their cartographic materials and compared notes one last time before setting off.? Each one carried the same bright yellow GPS device Li was toting.

Li, who took part in the last panda census, said new technology has had a huge impact on their work.? ?We can get a lot more done more quickly,? he said, with the GPS device shaving the amount of time in the field down by about?30 percent.

Each tracker is assigned a near-vertical tract of land to explore.? On average, they cover 1.2 to 1.5 square miles a day, looking for panda droppings.? (A typical male panda roams in a territory about 3.3 square miles whereas a female confines herself to 1.8 square miles.) ?Li found a pile that looked like it had been produced within the past three days, which he bagged and brought back to base camp for analysis.

?We take a sample for DNA testing,? he said as he prepared the panda waste.? ?The DNA test demands fresh feces not more than four days old.? This is very fresh.?

But DNA testing isn?t foolproof so Li and his colleagues also measured the undigested bamboo scraps to help identify the pandas individually.? ?We measure the width of the teeth marks,? he explained. ?Each bear has an individual bite with differing teeth sizes.

Habitat challenges
While in the panda?s natural habitat, the research teams also take detailed notes of the conditions and its geology.?

?What people normally care about is the number of the pandas,? said Gu Xiaodong, a scientist with the Sichuan branch of the Wildlife Survey Conservation and Management in the Forestry Department.? ?We care more about the quality of their habitat.?

With the data the trackers are collecting, the scientists will be able to analyze changes to the habitat and "draw up more effective conservation policies," continued Gu.? ?For example, last time we found pandas in locations between the reserves we had established,? he said.? ?So we had to set up more reserves to protect these pandas.?

Adrienne Mong

Li Guiren and other researchers measure undigested bamboo in the panda droppings to help identify each animal.

Researchers also hope to have more detailed information about the impact of the 2008 Sichuan earthquake, which measured 7.9 (by the U.S. Geological Survey) and devastated the famed Wolong Giant Panda Reserve Center, one of the earliest research bases set up by the Chinese government in the early 1980s.?

But humans remain the biggest threat to the survival of wild pandas.

With more than 80 million people, Sichuan is one of China?s more densely populated provinces. ?In recent years, it has seen large inflows of government investment and is rapidly urbanizing.? Scientists have cited roads and high-speed railways as a major hazard encroaching on the panda?s natural habitat in the mountains.

But mining is also a problem.? The day we trudged up the mountain with Li and Gu, we passed a couple of mines?one of them lead, whose run-off cast an unhealthy gray tinge to the river.? Loud explosions went off even during our hike, unsettling us as much as the pandas.

?The place where we are doing research now, it?s always been a traffic-intensive area with a lot of human activity,? said Gu.? ?The pandas here probably choose to go higher.?

But they still sometimes descend into human territory, especially if it means getting something to eat other than bamboo plants.?While the giant panda's diet consists mostly of bamboo,?they do have the digestive system of carnivores.?

Gu confirmed that local farmers have regularly complained about pandas raiding their livestock.? ?One farmer has his goats eaten by pandas every year,? recalled Gu, who said the Forestry Department offers compensation in such instances.

Mating challenges
Mating habits are also a challenge, particularly for pandas in captivity.

Female pandas are only in heat for three days a year.? The window for conceiving is very narrow?from 12 to 24 hours during those 72 hours.

Adrienne Mong / NBC News

The panda's natural habitat is a rugged landscape, but it's also being encroached by China's westward development.

Pandas in the wild don?t generally have a problem reproducing, said Huang from the breeding center.? But those in captivity usually need a bit of help?whether through artificial insemination or even the famed panda porn method.

Despite the success in breeding the cuddly animals in captivity, there?s been none so far in re-introducing fully domesticated pandas into the wild.

Nonetheless, researchers say they think breeding programs and conservation efforts have worked to keep the panda from advancing any closer to extinction.

?We really hope once the census is done, we?ll find more pandas than we found in the last census,? said Li.? ?That will mean what we?ve been doing has made progress.?

And if the scientists are right, that will make at least one civilian very happy.

A man by the name of An Yanshi in Sichuan is collecting panda poop by the bucket-loads to make tea?with curative properties.

?Pandas have a very poor digestive system and only absorb about?30 percent of everything they eat,? An has been?quoted as saying.? ?That means their excrement is rich in fibres and nutrients.?

He plans to market the tea as the world?s most expensive?at $36,000 a poop.? A pop.? A pound.

HIV numbers hit new high as AIDS drugs save lives (Reuters)

LONDON (Reuters) ? More people than ever are living with the AIDS virus but this is largely due to better access to drugs that keep HIV patients alive and well for many years, the United Nations AIDS programme (UNAIDS) said on Monday.

In its annual report on the pandemic, UNAIDS said the number of people dying of the disease fell to 1.8 million in 2010, down from a peak of 2.2 million in the mid-2000s.

UNAIDS director Michel Sidibe said the past 12 months had been a "game-changing year" in the global AIDS fight.

About 2.5 million deaths have been averted in poor and middle-income countries since 1995 due to AIDS drugs being introduced and access to them improving, according to UNAIDS.

Much of that success has come in the past two years as the numbers of people getting treatment has increased rapidly.

"We've never had a year when there has been so much science, so much leadership and such results in one year," Sidibe said in a telephone interview from UNAIDS in Geneva.

"Even in this time of public finance crises and uncertainty about funding, we're seeing results. We are seeing more countries than ever before (achieving) significant reductions in new infections and stabilising their epidemics."

Since the beginning of the AIDS pandemic in the 1980s, more than 60 million people have been infected with the human immunodeficiency virus (HIV) that causes AIDS. HIV can be controlled for many years with cocktails of drugs, but there is as yet no cure.

TREATMENT FOR PREVENTION

The UNAIDS report said 34 million people around the world had HIV in 2010, up from 33.3 million in 2009.

Among the most dramatic changes was the leap in the number of people getting treatment with AIDS drugs when they need it.

Of the 14.2 million people eligible for treatment in low- and middle-income countries, around 6.6 million, or 47 percent, are now receiving it, UNAIDS said, and 11 poor- and mid-income countries now have universal access to HIV treatment, with coverage of 80 percent or more.

This compares with 36 percent of the 15 million people needing treatment in 2009 who got AIDS drugs.

"In just one year we have added 1.4 million people to treatment," said Adrian Lovett of the anti-poverty campaign group ONE. He said the figures showed "huge progress" but also underlined "the major push needed now in order to turn the corner in this epidemic".

Major producers of HIV drugs include Gilead, Bristol Myers Squibb, Merck, Pfizer and GlaxoSmithKline. Improved access to drugs from these and other manufacturers means not only that fewer people are dying of AIDS each year, UNAIDS said, but also that the risk of new HIV infections is reduced.

A series of scientific studies have shown that getting timely treatment to those with HIV can substantially cut the number of people who become newly infected with the virus.

Sidibe said this was starting to show in new case numbers.

There were 2.7 million new HIV infections worldwide in 2010, 15 percent fewer than in 2001, and 21 percent below the number of new infections at the peak of the epidemic in 1997.

"The big point for us is the number of new infections --that's where you win against the epidemic," Sidibe said.

Medical charity Medecins Sans Frontieres (MSF) said the growing number of averted AIDS deaths was important progress. However, it added that the number of people on treatment needed to increase dramatically to reap the benefits of science.

"Never, in more than a decade of treating people living with HIV/AIDS, have we been at such a promising moment to really turn this epidemic around," said MSF's Tido von Schoen-Angerer.

"Governments in some of the hardest hit countries want to act on the science, seize this moment and reverse the AIDS epidemic. But this means nothing if there is no money to make it happen."

Despite progress on HIV treatment and prevention, sub-Saharan Africa is still by far the worst hit area, accounting for 68 percent of all those living with HIV in 2010 despite its population accounting for only 12 percent of the global total.

Around 70 percent of new HIV infections in 2010, and almost half of all AIDS-related deaths, were in sub-Saharan Africa.

Sidibe said that with many international donor countries struggling with slow economic growth and high debt, the global AIDS fight had to become even more focused on high impact interventions to deliver progress in the places worst hit.

"We need to maintain our investment, but ... in a smarter way. "Then we'll see a serious decline in the epidemic," he said.
